Booking Terms & Conditions

Please take the time to read and understand the terms and conditions as set out in this document prior to booking a trip with Blaycation Travel. We strongly recommend that you also read the country’s requirements as they pertain to your trip including any visa requirements in order to travel. We also ask that you review your trip’s itinerary to ensure that you understand all requirements, inclusions and exclusions prior to booking your trip with us.


The Contract


All bookings are made with Blaycation Travel. From here on referred to as Blaycation. Booking a trip with us is an indication that you are agreeing to the terms and conditions (which constitutes the entire agreement between you and Blaycation) and your booking will be accepted and confirmed by us on this basis.


Deposit Requirement


 

To reserve your trip, we require a deposit of US$1,000 per person. The balance of your payment is due 60 days prior to departure. If reserving your trip within 60 days of departure, full payment is required. (Deposit amounts, conditions, and payment schedules may vary for private departures, please call for more details.) To complete your reservation, you must complete, sign and return a Traveller Information Form and an Acknowledgement of Risk, Release and Indemnity within 14 days of the receipt of your confirmation package, which will include these forms. These forms include additional terms and conditions of travel, including limitations of our obligations to you. Prices for our ‘Private’ trips are quoted as part of the trip design process and are not final until final payment has been received

 

Acceptance of Booking and Final Payments

 


Acceptance of your booking will be confirmed by us in writing. Please refer to your booking confirmation and invoice for details regarding any final or outstanding payments. Payment of the balance of the trip fee is due 60 days prior to the departure date. If the balance is not paid on or before the expressed date we reserve the right to treat your booking as cancelled. Please note that special payment requirements may be applied to trips booked as part of our customized Services.


Your Details

 


In order for us to confirm your travel arrangements and guarantee your booking with our tour operators, you must provide all required details to us when the balance of the trip is paid. The required details include the following; your full name as per your passport, date of birth, nationality, passport number, passport issue and expiry date and any pre-existing medical conditions which may affect your ability to complete your travel arrangements. We may also require you to complete our Medical Release Form and submit this information 30 days prior to confirmation of your booking. If you book your trip within 30 days of departure, this documentation is required 5 days following the booking date. Your booking can not be confirmed without the provision of these details.


Late Bookings

 


A late booking is deemed any booking made less than 60 days before the scheduled departure date. A late fee may be applied to cover any additional costs related to last minute bookings.


Cancellation by the Traveler

 


Any trips cancelled following a booking may result in a loss of any fees or deposit paid to Blaycation. This is dependent upon the cancellation date as outlined below. Notice of cancellation will become effective from the date that written confirmation of the cancellation is received. The terms and conditions when a booking is cancelled based on the cancellation date are as follows;

  1. 60 days or more prior to departure, Blaycation will retain the deposit; but the deposit can be applied toward the cost of a trip offered by Blaycation, subject to availability

  2. Less than 60 days but more than 31 days prior to departure, Blaycation will retain 60% of the tour fee, or the total cost of non-refundable services, whichever is greater.

  3. Less than 30 days prior to departure, we will retain 90% of the tour price, or the total cost of non-refundable services, whichever is greater. You are strongly advised to take out cancellation insurance at the time of booking which will cover cancellation penalties in certain circumstances.  If you leave a trip for any reason, after it has commenced we are not obligate to make any refunds for services not rendered.

 

Cancellation by Blaycation

 

Blaycation reserves the right to cancel any trip at any time for any reason determined in our sole discretion, or if the quality of the trip or the safety of travellers is judged by Blaycation to be compromised. In such a case, Blaycation will endeavor to refund payments received by Blaycation. We ask that our valued clients recognize that there are expenses, including unrecoverable third-party deposits, that Blaycation cannot recoup as the planned date of a trip approaches and as a result, a 100% refund is not always possible. However, we are making every effort to recover, for the benefit our travelers, as many of those expenses as we are able.

Blaycation retains the sole discretion to run any trip notwithstanding the occurrence of any event or the existence of any condition in or near any place of travel included on a trip itinerary or in proximity to such a place or affecting travel, including air travel, in general. If Blaycation determines in good faith to run a trip, then no refund under this paragraph shall be payable with respect to that trip and any traveller cancelling a reservation shall be bound by the cancellation policies identified in the preceding paragraphs.


Booking Amendments

 


No amendments are permitted to your booking within 30 days of the departure date at which time the cancellation policy outlined in this contract will apply.


Inclusions

 


The land price of your trip includes the following:

  1. All accommodations as listed in the specific tour itinerary

  2. All transport listed in the specific tour itinerary, including internal flights where specified

  3. Sightseeing, activities, guide and entrance fees as outlined in the specific tour itinerary

  4. Meals as listed in the specific tour itinerary

 

Exclusions

 


The land price of your trip does not include:

  1. International flights and all associated fees

  2. Airport or port taxes

  3. Excess baggage charges on internal flights

  4. Meals other than those specified in the specific tour itinerary

  5. Visa and passport fees

  6. Travel insurance

  7. Optional free time activities including sightseeing and all personal expenses

  8. Tips at your discretion

Prices & Surcharges

 


All of our trip prices are based in Canadian $ or Euro €  and are based on current currency exchange rates  We reserve the right to impose surcharges up to 60 days before departure due to unfavorable changes in exchange rates, increases in airfares or other transportation costs, increases in local operator costs, taxes, or if government action should require us to do so. If any surcharge results in an increase of more than 10% of the trip price you may cancel the booking within 10 days of notification of the surcharge and obtain a full refund.


Age

 


While there are no limitations on age for Blaycation tour packages, we may be limited in our ability to make accommodations for younger and older travelers. Children under the age of 18 must be accompanied by a dedicated adult who will be responsible for the children’s day to day supervision. Please note we cannot guarantee triple or adjoining rooms for families. Any exceptions to this policy will be dealt with on a case by case basis and are subject to written approval by Blaycation. A medical release form is required for all passengers.


Passport and Visas

 


You must carry a valid passport and have obtained all of the appropriate visas, permits and certificates for entrance into the country or countries you will be visiting during your trip. Your passport must be valid for 6 months beyond the duration of the trip. It is your responsibility to ensure that you are in possession of the correct visas, permits and certificates for your trip; please refer to the consulate for these requirements for the applicable country or countries you will be visiting. Blaycation will not be held responsible


Travel Insurance

 


Travel insurance is compulsory for all travelers. Your travel insurance must provide cover against personal accident, death, medical expenses and emergency evacuation with a recommended minimum coverage of US$200,000 for each person. We strongly recommend your insurance also include cover for cancellation, curtailment, personal liability and loss of luggage and/or personal effects. You must provide proof of your travel insurance 7 days prior to scheduled trip departure. You will not be able to depart on your trip without proof of insurance. We do not provide travel insurance but we can recommend a travel insurance agent to assist you in securing your travel insurance or you may secure travel insurance through another insurance provider.


Change of Itinerary

 


While we endeavour to operate all trips as outlined in the trip’s itinerary, we reserve the right to change the trip itinerary where necessary. Before departure: If there is a major change in the itinerary we will inform you as soon as is reasonably possible and prior to departure wherever possible. A major change is defined as a change affecting at least one day out of five in the itinerary. When a major change is made you may choose between accepting the change, obtaining a refund of money paid on the land portion of the trip only or accepting the alternative tour offered. After departure: We reserve the right to change an itinerary after departure due to circumstances outside of our control. In emergency circumstances, the additional cost of any necessary itinerary alterations will be covered by you. Please note we are not responsible for any incidental expenses that may be incurred as a result of the change of itinerary such as visas, vaccinations or non-refundable flights.
 

Flexibility

 


You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility. The itinerary provided for each trip is representative of the types of activities contemplated, but it is understood that the route, schedules, sightseeing, activities, flights, itineraries, hotels, amenities and mode of transport may be subject to alteration without prior notice due to events in the region beyond our control.


Authority on Tour

 


Our group trips are run by a Blaycation Tour Leader or a third party tour partner. Any and all decisions of the Tour Leader are final on all matters likely to affect the safety, interest, or well-being of any person participating in the trip. You must at all times comply with the laws, customs, and foreign exchange and drug regulations of all countries visited. If you have a condition, medical or otherwise, that might affect other people’s enjoyment of the tour; you must advise us at the time of booking. Failure to comply with the above terms and conditions or engagement in any illegal activity when on the tour may result in immediate termination of your trip. Under these circumstances Blaycation will not assume any liability nor will you be entitled to a refund for services not rendered or any costs incurred resulting from the termination of the travel arrangements.


Acceptance of Risk

 


You acknowledge that the nature of the trip is adventurous and that your participation involves a degree of personal risk. You will be visiting locations where cultural, political and other situations may present dangers and physical challenges. We do our best to get updates from internal government departments and reports from our own contacts in assessing whether the trip can be operated safely in the region or country. The traveler also has a responsibility to acquaint themselves with all relevant travel information and the details of your trip’s itinerary. You acknowledge that your decision to travel with Blaycation is made in light of consideration of this information and you accept that you assume the personal risks associated with such travel.

All Blaycation trips are intentionally designed to take clients “off the beaten path” to places where facilities, infrastructure, safety and other standards may not be sophisticated and may be different from those in a traveller’s home country. Trips involve physical activity that can be demanding, depending on the condition of the traveller, and the risk of serious personal injury, including permanent disability and death from accident, illness or the actions or negligence of other persons. Medical facilities and services may not be easily accessible and may not be sophisticated. There are other risks associated with the trips, such as theft or loss of or damage to property. Some of the services provided in connection with the trip, including lodging, transportation, food service, and local tours and activities, are obtained from independent suppliers over whom Blaycation has no control.


Limitation of Liability, Release and Indemnity

 


We contract with a network of Tour Operators and companies, government agencies and individuals to assist in the running of our trips as agent for these third parties. We are not responsible for the acts and omissions of these third parties. To the fullest extent permitted by law: Any liability for any loss, death, injury or damage which you may suffer (directly or indirectly) in connection with or arising out of your participation on your trip, or any breach of the Terms and Conditions, is excluded; you release us and our officers, employees, agents and representatives from any liability and expressly waive any claims you may have against us arising out of or in connection with your participation in a trip; and any condition or warranty which would otherwise be implied by law into these Terms and Conditions (Implied Warranty), is excluded. Any claim by you is excluded to the extent that it is for indirect or consequential loss, loss of profits or economic loss, however it arises, or for indirect, special, punitive or exemplary damages.

When pricing each Blaycation trip, we strictly and expressly rely on each traveller to read, sign and return our standard Acknowledgement of Risk, Release and Indemnity form. This document will be sent to you after you have paid your initial deposit. The document must be completed and returned to us at least 100 days prior to the trip’s departure. Our receipt of the completed and signed form will complete your reservation.*


Optional activities

 


Any and all optional activities not included as part of the trip’s itinerary do not form part of the trip or this contract. You accept that any assistance given by your tour leader or local representative in arranging optional activities does not render us liable for these optional activities.
 

Errors & Omissions

 


We have made a concerted effort to verify the accuracy of statements made in our trip documentation including our website, country information, invoices and itineraries. We cannot be held responsible for any error, omission or unintentional misrepresentation that may occur.
 

Claims & complaints


If you have a complaint about your trip please inform your Tour Leader or our local representative at the earliest possible opportunity to allow  time for them to attempt to rectify the matter. If satisfaction is not reached through these means then you may contact Blaycation directly. Any further complaint should be put in writing to us within 30 days of the end of the tour.
 

Severability

 


In the event that any term or condition contained in these Terms and Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason then such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.
Photography and marketing
You consent to us using images of you taken during the trip for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes.


Applicable law

 


The laws of the province of Nova Scotia, Canada govern these Terms and Conditions and any disputes in connection with a trip or these Terms and Conditions must be initiated in the courts of the province of Nova Scotia, Canada.
